Supreme Court’s decision in Jaggo case gives new hope to thousands of contractual employees

The historic decision given by the Supreme Court in the case “Jaggo vs. Government of India (2024)” has brought a new ray of justice to lakhs of employees who have been serving under contractual and outsourcing for years.

This was stated during a meeting of the Advisory Committee of All Contractual Karamchari Sangh Bharat (Regd.), UT, Chandigarh.
Bipin Sher Singh, Chairman said that this decision is not only a legal achievement for those contract employees who were deprived of job security due to the one-time fixed limit of the Supreme Court’s directive in Uma Devi vs State of Karnataka (2006), but is also a moral and social support for all those employees who have been working for decades on par with permanent employees, but still have been deprived of their rights. He has demanded from the government and the Chandigarh administration that without any further delay, it should immediately implement the policy of regularization and job security like fellow states.
He said that the one-time regularization exemption given by the Supreme Court in the case of ‘Uma Devi vs State of Karnataka’ in 2006 was implemented in a limited manner by the governments, giving legal form to the exploitation of contract employees. The administration made it a tool to avoid permanent appointments. But the “Jaggo case” has broken this myth and said that employees who have been working on regular basis for years cannot be thrown out just because they were on contract.

He said that there are employees in every department in Chandigarh who have been working for 10 to 20-25 years, yet they have no job security, no pension, no health facilities. No more. We want the policy which has been implemented in Punjab, Haryana and other states.
Another member of the Advisory Committee, Tarandeep Singh Grewal said that the Supreme Court has made it clear that long-term service cannot be ignored. The employees who have been the backbone of the government machinery for years should now get justice, not just in court orders, but in ground reality.
Advisory Committee member and advocate Bhupinder Singh Gill said that by misinterpreting the Uma Devi case, the administration had crushed the hopes of thousands of employees. Now the Jaggo case has made it clear that this policy of the government was not only unjust but also against constitutional values.
The union also warned that if the administration did not take any decision soon, a massive mass movement would be launched in Chandigarh.
This decision is not only a victory for the temporary employees, but also for every contract employee like data entry operator, lab assistant, security guard, gardener and school teacher, higher education teacher who always supported the system but got only promises and rejections in return.

As per the Supreme Court’s direction in Jaggo vs Union of India, various honourable High Courts of the country have given instructions to protect the jobs of thousands of contract employees deprived by the Uma Devi decision.
Now the time has come that the Government of India should implement it in reality, not on paper. This will be the true respect of supreme justice.
The union put forward the main demands:
1. All contract and outsourced employees working on approved posts for 10 years or more should be given one-time regularization or job security.
2. As per the order of Jaggo of the Supreme Court, a review committee should be formed in all departments with immediate effect.
3. The contract system should be phased out or secured.
